These Terms of Service (“Terms”) are an agreement between you (“Customer”, “you”, or “your”) and Hostimizer.com, operated by LithiumWeb Online Services LLP (“Hostimizer”, “we”, “us”, or “our”). By ordering, renewing, accessing, or using a service, you accept these Terms together with the applicable plan, order, Acceptable Usage Policy, Privacy Policy, Refund Policy, and any written service-specific terms.
1. Eligibility and account information
You must be legally able to enter a contract and provide accurate, current contact, billing, and identity information. You are responsible for your account, authorised users, passwords, and all activity under your credentials. Notify us promptly of unauthorised access or changes that affect verification.
2. Orders, verification, and activation
An order is subject to payment, fraud and identity checks, product availability, and acceptance by Hostimizer or the relevant provider. Typical activation times are estimates, not guarantees. Domains, custom servers, migrations, development, and third-party products may require additional information or time. We may reject or cancel a high-risk, inaccurate, unlawful, or unavailable order and return any amount received for an unfulfilled service.
3. Services
We provide the features and resources stated in the selected plan or written proposal. Hosting and server resources may include stated limits for storage, CPU, memory, bandwidth, websites, databases, accounts, or support. “Unlimited” or “unmetered” means no fixed meter for normal lawful use; it does not permit abusive, disruptive, or commercially unreasonable consumption.
VPS and dedicated servers are unmanaged unless the order expressly includes management. You are responsible for operating systems, applications, licences, updates, security, and backups on unmanaged services. Assistance outside the included scope may be chargeable.
4. Domains and third-party services
Domain registration, renewal, transfer, and restoration depend on registry and registrar rules. A requested domain is not secured until registration is confirmed. You must keep registrant details accurate and comply with applicable domain policies. Third-party products—including licences, SSL certificates, payment services, control panels, app stores, social platforms, maps, and virtual numbers—are also subject to their provider’s terms, decisions, and availability.
5. Professional and digital services
For website development, mobile apps, SEO, social media, Google Maps, and other project work, scope, deliverables, revisions, milestones, dependencies, and timing are defined by the order or proposal. You must provide timely content, access, approvals, and lawful materials. Delays caused by missing feedback, access, or content may change delivery dates.
Unless agreed otherwise in writing, ownership of custom final deliverables transfers after full payment, excluding our pre-existing tools, licensed assets, open-source software, methods, and third-party materials. Drafts and unpaid work remain ours. We do not guarantee rankings, traffic, sales, followers, verification, app-store approval, or platform decisions.
6. Customer content and lawful use
You retain rights in content you supply and grant us the limited permission needed to host, copy, process, migrate, display, or modify it to provide the service. You confirm that you have all necessary rights and permissions. Services must comply with our Acceptable Usage Policy and applicable law.
7. Fees, taxes, and renewal
Fees are payable in advance unless a written agreement says otherwise. Prices may change for future billing periods because of supplier costs, exchange rates, taxes, product changes, or promotions. Any renewal price shown in the order or client area applies to that renewal. You are responsible for applicable taxes, bank charges, currency conversion, and third-party fees.
Recurring services may renew automatically where enabled. You must cancel before the next billing date to avoid renewal. If payment is overdue, we may restrict or suspend the service and may charge a reasonable reactivation or recovery fee disclosed before reinstatement.
8. Cancellation and refunds
You may request cancellation through an authorised support channel. Stopping use or allowing a service to expire is not a cancellation request. Refund eligibility, exclusions, and processing times are governed by our Refund Policy. In summary, the seven-day money-back guarantee applies only to eligible first-time shared or reseller hosting purchases; domains, VPS, cloud and dedicated servers, renewals, licences, add-ons, and professional or digital services are generally non-refundable once ordered, activated, registered, provisioned, or started.
9. Suspension and termination
We may suspend or terminate service for non-payment, inaccurate account details, security risk, fraud, abuse, unlawful activity, violation of these Terms or the AUP, a binding legal request, or risk to our infrastructure or others. We will provide notice where reasonably possible, but may act immediately where urgent protection is required. Suspension does not remove payment obligations.
10. Backups and customer data
You are responsible for maintaining current, independent backups. Where a plan includes backup features, they are provided as an additional recovery aid and are not guaranteed to contain every file, message, database, or restore point. We are not responsible for loss caused by customer action, compromised credentials, unsupported software, or failure to maintain independent copies.
After expiry, cancellation, or termination, data may be deleted without further notice and may not be recoverable. Download required data before cancelling or allowing a service to expire.
11. Support and communications
Support covers the service scope stated in your plan. We may need account verification before discussing or changing a service. Response and resolution times are targets unless a written service-level agreement expressly makes them commitments. You must communicate respectfully; threats, harassment, or repeated abuse of staff or support systems may result in restricted communication or termination.
12. Availability and maintenance
We work to provide reliable services, but maintenance, security incidents, attacks, hardware or software faults, upstream providers, registries, utilities, and events beyond reasonable control may cause interruption. Any uptime commitment or service credit applies only when expressly stated for the affected plan and is the remedy for that commitment.
13. Intellectual property
Hostimizer names, branding, website content, software, and documentation are owned by us or our licensors. You may not copy, resell, reverse engineer, or misuse them except as permitted by law or written agreement. You remain responsible for claims that customer content or instructions infringe another party’s rights.
14. Warranties and liability
Except for express written commitments and rights that cannot be excluded, services are provided “as is” and “as available”. To the fullest extent permitted by law, we are not liable for indirect, special, incidental, punitive, or consequential loss, including lost profit, revenue, goodwill, opportunity, or data.
Where liability cannot be excluded, our total aggregate liability relating to a claim is limited to the amount you paid for the affected service during the three months immediately before the event giving rise to the claim. Nothing in these Terms limits liability that applicable law does not permit us to limit.
15. Indemnity
You agree to indemnify Hostimizer against third-party claims, losses, and reasonable costs arising from your content, products, instructions, unlawful activity, infringement, or material breach of these Terms, to the extent permitted by law.
16. Changes
We may update services, plan features, and these Terms for legal, security, operational, or commercial reasons. The current version is published on this page. Material changes affecting an active paid service will be communicated where reasonably required. Continued use after an effective update constitutes acceptance, subject to applicable law.
17. Governing law and disputes
These Terms are governed by the laws of India. Courts with jurisdiction over Prayagraj (Allahabad), Uttar Pradesh, India will have jurisdiction, unless applicable consumer law requires otherwise. Please contact us first so we can try to resolve a concern promptly.
